1. Purpose and acceptance

These Terms of Use (“Terms”) govern access to and use of the Pump Me mobile application and, where applicable, related services available from pump-me.cyrillevarin.com.

By downloading, installing or using the App, you confirm that you have read and accept these Terms without reservation. If you do not agree, you must not use the App.

2. Description of the service

The website pump-me.cyrillevarin.com is hosted by IONOS SE (Montabaur, Germany). The mobile app may rely on other technical infrastructure (see the privacy policy).

Pump Me lets you view information about forecourts and fuel prices (subject to available data and covered regions), use mapping, filters, cost estimates, alerts or favourites, and any other tools offered in the App.

The service is provided “as is”. Features may change, be modified, suspended or withdrawn for technical, legal or commercial reasons, with reasonable notice where possible.

3. Access requirements

Using the App requires a compatible device and, for some features, an internet connection and permissions (location, notifications). You are responsible for connectivity charges and hardware.

You agree to provide accurate information when requested and not to impersonate anyone else.

4. Nature of information — no warranty

Prices, opening hours, services and other data come from third-party sources (including open datasets, public APIs or enrichment). They are provided for information only.

The publisher does not guarantee accuracy, completeness, timeliness or continuous availability. The price at the pump may differ. Always check on site before travelling or filling up.

Routes and distances (including “road” or “as the crow flies”) are estimates; driving and compliance with traffic law remain solely your responsibility.

5. Intellectual property

The App, its design, text, graphics, logos, trade marks, source code (except separately licensed open-source components) and structured databases are the property of the publisher or its licensors. Unauthorised copying or use is prohibited.

6. User conduct

You must not, among other things: circumvent security; attempt unauthorised access; use the App for unlawful, harmful or fraudulent purposes; overload infrastructure; scrape services abusively; or infringe third-party rights.

The publisher may suspend or restrict access in the event of serious or repeated breach of these Terms.

7. Reports and user content

If the App allows reports or other content, you warrant that it is lawful and does not infringe others’ rights. You grant the publisher a non-exclusive, worldwide, royalty-free licence to use that content only to handle the report and improve the service.

8. Third-party links

The App may open links to third-party sites or apps (app stores, maps, navigation). Those services have their own terms; the publisher is not responsible for their content.

9. Personal data

Processing of personal data is described in the Privacy policy, which forms part of these Terms for information purposes.

10. Limitation of liability

To the fullest extent permitted by applicable law, the publisher shall not be liable for indirect damage, loss of data, loss of business, lost profits or harm arising from use or inability to use the App, including price errors or service unavailability.

Where liability cannot be excluded, total compensation payable by the publisher in any calendar year may be limited to any amount you paid for the App in that period (if the App is paid); otherwise to the minimum symbolic amount allowed by law.

Some jurisdictions do not allow certain limitations; in that case limitations apply to the maximum extent permitted.

11. Force majeure

The publisher shall not be liable for events beyond reasonable control (disasters, conflict, authority decisions, widespread network failures, etc.).

12. Changes to the Terms

These Terms may be updated. The “last updated” date will be revised. Material changes may be communicated (in-app notice, website message). Continued use constitutes acceptance, except where mandatory law requires otherwise.

13. Termination

You may stop using the App at any time. The publisher may end access to the service or a feature with reasonable notice where possible.

14. Governing law and disputes

These Terms are governed by French law, without prejudice to mandatory consumer protections more favourable to you in your country of habitual residence.

In case of dispute you may use consumer mediation or the competent courts in accordance with applicable procedural rules.

15. General

If any clause is invalid, the remainder stays in force. Failure to enforce a right is not a waiver.
